iShoot.Direct LLC (“iSD”)

By visiting our iShoot.Direct or iShootdirect.com (together, the “Website”), or using our application (the “Application,” and together with the Website, the “Services”) you consent to these Terms and Conditions (the “Terms”). If you do not want to be bound by the terms of this Agreement, you should not use the Website or the Services. This is not an agreement to provide services.

Before you continue using our website, we advise you to read our privacy policy regarding our use and/or collection of user data. These Terms are meant to be read in conjunction with the privacy policy. You agree to the policy as well as the Terms by using the Services. By providing your contact information, such as your mobile phone number, you agree that we may contact you and or provide the Services through your mobile phone and you acknowledge that message and data rates may apply.

You grant iSD a royalty-free and non-exclusive license to use, copy, transmit, and broadcast the content you upload and publish solely as necessary to provide and ensure the quality of its video direction services. For issues regarding intellectual property claims, you should contact the company in order to come to an agreement.

Notwithstanding the foregoing, iSD does not claim ownership over video materials produced using the Website or the Services and makes no warranties or representations regarding same.

Third Parties

iSD utilizes third party platforms and providers to optimize, support, host and distribute the Services. This includes but is not limited to Google's YouTube API. User accounts

As a user of this website, you may be asked to register with us and provide private information. We use such information only as detailed in our privacy policy. Disputes

Indemnification

You agree to indemnify, defend and hold harmless iSD and its affiliates against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.

Direction from iSD

iSD provides, among other things, remote video directorial services, as such, users must follow instructions from their director to ensure the best possible video final product.

Limitation on liability

Unless expressly agreed otherwise, we provide the Services “AS IS” and make no representations regarding the outcome or effectiveness of its Services. iSD is not liable for any damages that may occur to you as a result of your misuse of the Website or the Services. iSD reserves the right to edit, modify, and change this Agreement at any time, effective as of the posting of these updates.

Video production

You understand and acknowledge that the video production and direction services provided by iSD are not consistent with or equivalent to a professional video shot with on-site crew with light kit, backdrops, audio gear, etc. Video quality will be consistent with web cam or smart device recordings.

This Agreement is an understanding between iSD and the user, and must be read in conjunction with both the privacy policy and any written engagement agreements between you and iSD. This Agreement may only be amended, modified or superseded by written agreements between the parties. The terms of this Agreement prevail and stay in effect unless the terms of such other written agreement expressly conflict or, by their terms, modify or amend this Agreement.

We at iShoot.direct LLC (“iSD”) value your privacy and your ability to be informed regarding how information about you may be used by us. As such, you should review this privacy policy (the “Privacy Policy”) prior to using our services. Your use of our services and/or provision to us of information about you is deemed an acceptance of the Privacy Policy and the data-related practices described herein.

The Services collect user-generated content as part of their core functions including audio and video transmitted live. We do not use this material for any purposes other than the delivery of our media production services. Take care that the setting in which you record audio or video for purposes of using the Services does not reveal personal information about you or others which you do not want revealed to the intended users or viewers of the video. Your usage of the Services constitutes your consent to our access to the video or audio you record using the Services.

Security of Your Personal Information

iSD secures your personal information from unauthorized access, use or disclosure. However, we do not guarantee 100% safety from hacks, other instances of cybercrime and other types of breaches.

Personal Information Request

If you are a resident of the California or of European Economic Area (EEA), you have the right to: (1) request access to your personal information and rectification of inaccurate personal information; (2) request erasure of your personal information; (3) request restrictions on the processing of your personal information; (4) object to processing your personal information; and/or (5) the right to data portability (“collectively, “Requests”). You may access the information we hold about you. If you wish to exercise this right, please contact us using support@ishoot.direct. If you would like to update, correct, modify or delete from our database any personal information you previously submitted to us, please let us know by accessing and updating your profile. If you delete certain information you may not be able to order services in the future without re-submitting such information. We will comply with your request as soon as reasonably practicable. Please note that we will maintain personal information in our database whenever we are required to do so by law. Please note that we need to retain certain information for record keeping purposes and/or to complete any transactions that you began prior to requesting such change or deletion (for example, when you enter a promotion, you may not be able to change or delete the personal information provided until after the completion of such promotion).
